These Trial Terms govern your use of the GetPrice platform during a free trial of the Service. They apply in addition to the GetPrice Terms of Service and Privacy Policy, which you should read before starting a trial. In the event of conflict with the Terms of Service during the trial period, these Trial Terms prevail.
By starting a trial, you confirm that you have authority to bind your organisation to these terms and to the Terms of Service, and that you accept both.
Eligibility. Free trials are available only to entities incorporated in the Republic of South Africa, consistent with the eligibility provision in the Terms of Service.
1. Trial Scope
1.1 Duration
The trial period is 14 calendar days from the date your trial account is activated.
1.2 What the trial includes
During the trial, you receive read-only access to the GetPrice dashboard with a limited sample of demonstration data. The trial is intended for evaluation only.
1.3 What the trial excludes
The trial does not include:
- live scraping of your nominated retailers or competitors;
- custom target-URL configuration;
- automated email reports;
- API access (none is currently offered);
- any service-level commitment.
2. No Fee, No Payment Method
The trial is free. We do not collect payment-method information to start a trial. There is no charge for the trial period.
3. No SLA, No Indemnity
The Master Service Level Agreement does not apply during a trial. The support response targets in the Master SLA do not apply during a trial. GetPrice gives no indemnity in respect of the trial.
The Customer indemnity in the Terms of Service (clause 6.5) and the Acceptable Use provisions (clause 2) apply during the trial.
4. Limitation of Liability
The Limitation of Liability in the Terms of Service (clause 6.1) applies, save that GetPrice's total aggregate liability for any claim arising from your use of the trial is limited to R1,000 rather than the cap in clause 6.1. This is an express derogation from the Terms of Service liability cap for the trial period only, reflecting that no fees are paid during the trial.
5. Acceptable Use
The Acceptable Use provisions in the Terms of Service (clause 2) apply to your use of the trial. You may not use the trial to circumvent paid usage limits, evaluate the Service for the purpose of building a competing product, or in any way prohibited by clause 2.2 of the Terms of Service.
6. Termination by GetPrice
GetPrice may terminate the trial at any time, with or without notice, for any reason or no reason, including (without limitation) suspected misuse, evaluation by a competitor, or operational reasons. No remedy is available for early termination of a trial.
7. End of Trial
At the end of the 14-day period, your trial access ends. No charge is made. To continue using the Service after the trial, you must enter into a paid subscription by signing the Master Service Level Agreement and an accompanying Order Form.
If you do not convert to a paid subscription, your trial account and associated data are deleted within 30 days of the trial ending.
8. Privacy
Your personal information processed during the trial is handled in accordance with the Privacy Policy. Marketing communications are sent only if you opt in.
9. Governing Law
These Trial Terms are governed by the laws of the Republic of South Africa. Disputes are resolved per clause 9 of the Terms of Service.
